These Terms & Conditions govern your use of the FCVPhotography website and the purchase of physical and digital products through it.
Please read them carefully before placing an order.
By using this website or placing an order, you agree to these Terms & Conditions. Nothing in these Terms excludes, limits or overrides any rights or remedies that cannot lawfully be excluded or limited under applicable consumer law.

2. Use of This Website
You may use this website for lawful personal and commercial browsing purposes and to purchase or enquire about the products and services offered through it.
You must not use the website in a manner that is unlawful, fraudulent, harmful, disruptive or that interferes with the operation or security of the website.
You must not attempt to gain unauthorised access to the website, its systems, customer information or any restricted areas.
3. Intellectual Property
Unless otherwise stated, the photographs, artworks, text, graphics and other original content appearing on this website are owned by Freddie Child-Villiers / FCVPhotography and are protected by applicable copyright and intellectual property laws.
Viewing this website or purchasing a product does not transfer copyright or reproduction rights.
In particular, the purchase of an Artist’s Proof, Exhibition Edition, Architectural Print or other physical artwork transfers ownership of that physical work only. Copyright and reproduction rights in the underlying photograph remain with Freddie Child-Villiers unless expressly transferred under a separate written agreement.

4. Artificial Intelligence, Data Mining & Automated Use
The photographs, images, artworks, text and other content on this website may not be scraped, extracted, copied or otherwise used without prior written permission for the training, development, fine-tuning, evaluation or operation of artificial-intelligence, machine-learning or generative-AI systems.
Systematic or automated collection, scraping, data mining, harvesting or extraction of website content is prohibited except where expressly authorised in writing or where such activity cannot lawfully be restricted.

5. Product Information
We take reasonable care to describe and present our products accurately.
Photographs displayed on a screen may differ slightly from the appearance of a physical print. Screen calibration, brightness, colour profiles and display technology can affect colour, contrast and tonal reproduction.
Our physical works are individually produced and finished. Minor variations in dimensions, borders, mounting, framing and finishing may therefore occur within reasonable production tolerances.
Such reasonable variations do not affect the authenticity or edition status of a work.
6. Fine-Art Prints & Editions
Where a photograph is offered as a limited edition or Artist’s Proof, the applicable edition structure is stated with that work.
Artist’s Proofs, numbered Exhibition Editions, Architectural Prints and other formats are produced according to the specifications stated for the relevant photograph or collection.
Purchasing a physical artwork does not transfer copyright in the underlying photograph.
Unless expressly stated otherwise, prices exclude shipping and any duties, taxes or charges that may be payable in the destination country.
7. Architectural Prints & Bespoke Orders
Architectural Prints and other bespoke works may be produced to custom dimensions and specifications agreed with the customer.
Quotations for bespoke works may depend on dimensions, materials, framing or mounting method, installation requirements, destination and other project-specific factors.
A bespoke order is not confirmed until its specifications and price have been agreed and any required payment has been received.
Once production of a custom or made-to-specification work has commenced, changes or cancellation may not be possible, subject always to applicable law.
8. Prices
Prices displayed on the website are shown in the currency indicated at the time of purchase.
We reserve the right to change prices prospectively at any time. A price change will not affect an order that has already been accepted at an agreed price.
Any shipping charges, taxes or other costs payable through checkout will be disclosed where applicable before the order is completed.
International customers may also be responsible for import duties, customs charges, local taxes or other fees imposed by authorities in the destination country.
9. Orders
Placing an order constitutes an offer to purchase the relevant product.
An automated acknowledgement or payment confirmation does not necessarily constitute final acceptance of an order.
We may decline or cancel an order where reasonably necessary, including in the event of:
an obvious pricing or product-description error;
suspected fraud or unauthorised payment;
inability to fulfil the order;
an edition no longer being available;
a technical or inventory error; or
circumstances that make fulfilment unlawful or impracticable.
If we cancel an order after payment has been received and no product has been supplied, the amount paid for the cancelled order will be refunded, subject to applicable law.
10. Payment
Payment must be made using the payment methods made available through the website or otherwise agreed with FCVPhotography.
Orders will not normally enter production until the required payment has been successfully received or otherwise agreed.
Payment processing may be provided by third-party payment providers and may be subject to their own terms and privacy policies.
11. Production Times
Physical prints are made to order.
Orders typically take up to 14 days to produce, although handmade, specialist, framed, bespoke or custom works may require additional time.
Any production or delivery date provided is an estimate unless expressly agreed otherwise.
If an order is required urgently or by a specific date, please contact us before placing the order.
12. Shipping
Physical orders are shipped from Cape Town, South Africa.
Tracking information will be provided when available once an order has left the studio.
Delivery times depend on the destination, courier and customs processes and are separate from production time.
International customers are responsible for applicable import duties, customs charges, taxes and other destination-country fees unless expressly stated otherwise.
Customs and courier delays outside our reasonable control may affect delivery times.
Customers are responsible for providing complete and accurate delivery information. Additional costs arising from an incorrect address, failed delivery or re-delivery may be charged to the customer where appropriate.

13. Made-to-Order Prints, Returns & Cancellations
Because physical prints are individually made to order, we do not accept returns, exchanges or cancellations for change of mind once production has commenced, subject always to your rights under applicable law.
This does not affect your rights where goods are defective, damaged, incorrectly supplied or otherwise fail to meet standards required by applicable law.
14. Damaged, Defective, Incorrect or Missing Orders
If an order arrives damaged, defective or incorrect, please contact us as soon as reasonably possible.
Please retain the original packaging and provide photographs of the artwork, packaging and visible damage where reasonably requested. This assists us in assessing the issue and pursuing any necessary courier or insurance claim.
Where an appropriate remedy is due, we will work with you to arrange a repair, replacement, refund or other remedy as required by the circumstances and applicable law.
If a shipment appears to have been lost in transit, please contact us so that we can investigate the matter with the courier.
15. Digital Products
Digital products are supplied electronically and remain protected by copyright and other intellectual property rights.
Except where required by applicable law, digital products are non-returnable and non-refundable once they have been supplied, downloaded or made available for download.
If a digital product is defective, corrupted or cannot reasonably be accessed as intended, please contact us so that we can investigate and, where appropriate, provide a replacement file, renewed access or another appropriate remedy.
Purchasing a digital product does not transfer copyright or ownership of the underlying intellectual property.
16. Digital Product Licence
Unless different licence terms are expressly provided with a particular digital product, your purchase grants you a limited, non-exclusive, non-transferable licence to use that product for your own permitted purposes.
You may not, unless expressly authorised:
resell or redistribute the digital product;
share the files with another person or business;
sublicense the product;
upload the files for public or shared access;
package or sell the files as part of another digital product; or
represent the digital product as your own work.
Any product-specific licence supplied with a digital product takes precedence over this general provision to the extent of any inconsistency.
17. Website Availability
We aim to keep the website accurate, secure and available, but do not guarantee that it will operate continuously or without interruption, delay or technical error.
We may update, suspend or modify parts of the website where reasonably necessary.
We are not responsible for temporary interruptions caused by maintenance, hosting providers, communications networks, third-party services or circumstances beyond our reasonable control.
18. External Links & Third-Party Services
This website may contain links to third-party websites or use third-party services, including payment, shipping, social-media or other service providers.
We are not responsible for the content, availability, security or privacy practices of third-party websites that we do not control.
The inclusion of a third-party link does not necessarily constitute an endorsement of all content or services provided by that third party.

Personal information is handled in accordance with our Privacy Policy.
The website may use cookies and similar technologies for functionality, security, analytics, commerce and other purposes described in our Privacy and/or Cookie Policy.
Where consent is required by applicable law, cookies requiring consent will be handled accordingly.
20. Liability
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, FCVPhotography will not be liable for indirect or consequential losses that were not reasonably foreseeable and that arise from use of the website or circumstances outside our reasonable control.
We are not responsible for losses arising solely from inaccurate information supplied by a customer, misuse of a product, unauthorised modification of a product, or failure to follow applicable care or usage instructions.
Any limitation or exclusion in these Terms applies only to the extent permitted by applicable law.
21. Events Beyond Our Reasonable Control
We will not be responsible for delay or failure in performance caused by circumstances beyond our reasonable control, which may include severe weather, natural disasters, fire, transport disruption, customs delays, courier disruption, power or communications failures, industrial action, governmental restrictions, civil disturbance or other comparable events.
Where such an event materially affects an order, we will take reasonable steps to communicate with the customer and determine an appropriate way forward.
22. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to the website, our products, our business or applicable requirements.
The version applying to an order will ordinarily be the version in effect when that order was placed, except where a change is required by law.
The current version will be published on this page with its latest revision date.
23. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.
24. No Waiver
If we do not immediately enforce a right or provision under these Terms, that does not mean that we waive that right or prevent us from enforcing it later.
25. Governing Law
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer-protection rights or other laws that may apply to a particular customer or transaction.
Nothing in these Terms is intended to prevent a consumer from exercising any right to approach a court, tribunal, consumer authority, ombud or other dispute-resolution body where that right exists under applicable law.
